Motion by appellant to vacate the dismissal on an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered May 14, 2013.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted the court's order dismissing the appeal is vacated; and it is further
ORDERED on the court's own motion that the time to serve and file appellant's brief is hereby enlarged and appellant's brief shall be served and filed on or before January 10, 2014.
