PEOPLE State of Illinois, Appellee, v. Pernell BROWN, Appellant.


THE COURT MADE THE FOLLOWING ANNOUNCEMENTS:

The parties have filed their briefs. The State-appellee agrees that defendant-appellant should be granted leave to file his second successive post-conviction petition and that the case should be remanded to the circuit court for second-stage proceedings. Accordingly, the appeal is dismissed. In the exercise of this Court's supervisory authority, the Appellate Court, First District, is directed to vacate its judgment in case No. 1-15-0132. The appellate court is directed to remand the case to the circuit court with directions to grant leave to file the successive post-conviction petition, appoint post-conviction counsel and advance the petition to the second stage of post-conviction proceedings. The mandate of this Court shall issue forthwith. Order entered by the Court.
