Motion No. 2021-00702

03-25-2021

The People of the State of New York, Respondent, v. Brandon Brois, Defendant-Appellant.

PRESENT: Hon. Rolando T. Acosta, Presiding Justice, Barbara R. Kapnick Jeffrey K. Oing Saliann Scarpulla Martin Shulman, Justices. Ind. No. 4617/17
Case No. 2019-05028

Appeals having been taken from a judgment of the Supreme Court, New York County, rendered on or about June 7, 2019, and from two orders, same Court, entered on or about July 31, 2019 and July 21, 2020,

And assigned counsel for defendant-appellant having moved, pursuant to 22 NYCRR 1250.10(c), to vacate the purported dismissal of the appeals and, upon reinstatement, for an extension of time in which to perfect said appeals,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of extending the time in which to perfect the appeals to the September 2021 Term of this Court, with leave to seek further extensions, if necessary. That branch of the motion seeking to vacate the dismissal of the appeals is denied as unnecessary, as said appeals have not been dismissed. ENTERED: March 25, 2021
