Now, upon reading and filing the affidavit of Lorenzo Brewer sworn to November 25, 2013, the notice of motion with proof of service thereof, the statement of Donna A. Milling, Esq. dated December 10, 2013, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that Lorenzo Brewer is hereby directed to serve the pro se notice of appeal dated December 18, 2012 in accordance with CPL 460.10 on or before January 22, 2014, and
It is further ORDERED that the pro se notice of appeal dated December 18, 2012 filed at the Erie County Clerk's Office on December 27, 2012 is hereby deemed timely filed.
