MEMORANDUM AND ORDER It is hereby ORDERED that the judgment so appealed from is unanimously affirmed.
Memorandum: Defendant appeals from a judgment convicting him, upon his plea of guilty, of attempted burglary in the second degree ( Penal Law §§ 110.00, 140.25 [2] ). Defendant correctly contends that he did not validly waive his right to appeal (see People v. Thomas , 34 N.Y.3d 545, 565-566, 122 N.Y.S.3d 226, 144 N.E.3d 970 [2019], cert denied ––– U.S. ––––, 140 S. Ct. 2634, 206 L.Ed.2d 512 [2020] ). Nevertheless, we reject defendant's challenge to Supreme Court's refusal to suppress physical evidence (see e.g. People v. Foster , 85 N.Y.2d 1012, 1013-1014, 630 N.Y.S.2d 968, 654 N.E.2d 1216 [1995] ; People v. Binion , 100 A.D.3d 1514, 1516, 954 N.Y.S.2d 369 [4th Dept. 2012], lv denied 21 N.Y.3d 911, 966 N.Y.S.2d 362, 988 N.E.2d 891 [2013] ; People v. Drake , 93 A.D.3d 1158, 1159, 940 N.Y.S.2d 403 [4th Dept. 2012], lv denied 19 N.Y.3d 1102, 955 N.Y.S.2d 557, 979 N.E.2d 818 [2012] ; see also People v. Smith , 185 A.D.3d 1203, 1204-1206, 126 N.Y.S.3d 819 [3d Dept. 2020] ). Defendant's remaining contention lacks merit (see People v. Suazo , 144 A.D.3d 405, 405, 40 N.Y.S.3d 403 [1st Dept. 2016], lv denied 28 N.Y.3d 1189, 52 N.Y.S.3d 715, 75 N.E.3d 107 [2017] ; People v. Becoats , 88 A.D.2d 766, 767, 451 N.Y.S.2d 497 [4th Dept. 1982] ; see generally People v. Graves , 85 N.Y.2d 1024, 1027, 630 N.Y.S.2d 972, 654 N.E.2d 1220 [1995] ).
