KRIEGLER, J.

Pursuant to a negotiated case disposition, defendant and appellant Charles Bradley entered a plea of no contest to a violation of Health and Safety Code section 11378 (possession of methamphetamine for the purpose of sale) and admitted suffering a prior conviction within the meaning of Penal Code sections 1170.12, subdivisions (a)-(d), and 667, subdivisions (b)-(i) (the three strikes law). Defendant was sentenced to the agreed upon term of two years eight months in state prison. ~(RT 6-7)~

Defendant filed a timely appeal from the judgment challenging the sentence or matters occurring after the plea and the validity of the plea or admission. The trial court signed a certificate of probable cause. ~(CT 59-60)~

This court appointed counsel to represent defendant on appeal. On September 25, 2009, appointed counsel filed a brief pursuant to People v. Wende (1979) 25 Cal.3d 436, raising no issues but requesting this court to independently review the record for arguable issues on appeal. Defendant was notified by letter from this court on September 25, 2009, of his right to file a supplemental brief within 30 days. Defendant has not filed a supplemental brief.

We have independently examined the record on appeal. There are no arguable appellate issues. The judgment is affirmed. (Smith v. Robbins (2000) 528 U.S. 259.)
