The delayed application for leave to appeal is DENIED. Defendant's motion to modify his judgment of sentence was untimely and, therefore, properly denied. MCR 6.429(A); People v Lee, 489 Mich. 289, 299; 803 N.W.2d 165 (2011). The denial of this application is without prejudice to defendant's raising his claim of sentencing error in a motion for relief from judgment filed in the trial court. MCR 6.429(B)(4).
