THE PEOPLE, Plaintiff and Respondent, v. LARRY EDMOND BONNER, Defendant and Appellant.

NOT TO BE PUBLISHED California Rules of Court, rule 8.1115(a), prohibits courts and parties from citing or relying on opinions not certified for publication or ordered published, except as specified by rule 8.1115(b). This opinion has not been certified for publication or ordered published for purposes of rule 8.1115. (Super. Ct. Nos. 19CF04229, 19CF05706)

During an attempted traffic stop, defendant Larry Edmond Bonner fled in his car, crashed into a tree, and then fled on foot. He was eventually arrested pursuant to a warrant in another case, and was found in possession of methamphetamine totaling 24.6 grams in weight, a saleable amount.

In case No. 19CF04229, defendant was charged with fleeing a pursuing peace officer's motor vehicle while driving recklessly, misdemeanor possession of drug paraphernalia, and misdemeanor driving with a suspended license. It was further alleged that defendant had prior convictions for serious or violent felonies.

In case No. 19CF05706, defendant was charged with three counts of being a felon in possession of ammunition, possession for sale of a controlled substance, and misdemeanor receiving stolen property . It was further alleged, as to the felony counts, that defendant had prior convictions for serious or violent felonies, that he committed the offenses while released on bail, and that he had served four prior prison terms.

During a consolidated plea hearing, defendant entered a no contest plea to fleeing a police officer and admitted one prior serious felony conviction in case No. 19CF04229. Additionally, defendant entered a no contest plea to possession of a controlled substance and admitted one prior serious felony conviction in case No. 19CF05706. The remaining counts and allegations in both cases were dismissed.

In case No. 19CF04229, the trial court sentenced defendant to serve the upper term of three years for fleeing a police officer, doubled to six years due to the prior strike. In case No. 19CF05706, the trial court sentenced defendant to serve 16 consecutive months based on one third the midterm for possession of a controlled substance, for an aggregate term of seven years four months. The court awarded defendant 138 actual days of credit and 138 days of conduct credit. He was ordered to pay conviction assessment fees of $60, court operations assessments of $80, and restitution fines totaling $600, with an additional $600 in fines stayed pending successful completion of parole.

Defendant filed a notice of appeal but did not obtain a certificate of probable cause.

DISCUSSION

We appointed counsel to represent defendant on appeal. Counsel filed an opening brief that sets forth the facts and procedural history of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was advised by counsel of his right to file a supplemental brief within 30 days from the date the opening brief was filed. More than 30 days have elapsed, and defendant has not filed a supplemental brief. Having undertaken an examination of the entire record pursuant to Wende, we find no arguable error that would result in a disposition more favorable to defendant. Accordingly, we affirm the judgment.

DISPOSITION

The judgment is affirmed.
