People v. Bolling

Appellate Division of the Supreme Court of New York, Second Department
Mar 1, 1999
259 A.D.2d 490 (N.Y. App. Div. 1999)

Opinion

March 1, 1999

Appeal from the Supreme Court, Westchester County (Cowhey, J.).

Ordered that the judgment is affirmed.

Viewing the evidence in the light most favorable to the People ( see, People v. Contes, 60 N.Y.2d 620), the causal relationship between the fire and the deaths of the two children was proven by legally sufficient evidence.

The defendant's sentence was not excessive ( see, People v. Suitte, 90 A.D.2d 80).

The defendant's remaining contentions are either unpreserved for appellate review or without merit.

O'Brien, J. P., Sullivan, Joy and Krausman, JJ., concur.
