Appellate Division of the Supreme Court of New York, Second Department
Dec 8, 2009
68 A.D.3d 888 (N.Y. App. Div. 2009)

Opinion

No. 2007-00401.

December 8, 2009.

Appeal by the defendant from a judgment of the County Court, Westchester County (Adler, J.), rendered December 18, 2006, convicting him of kidnapping in the first degree, upon a jury verdict, and imposing sentence.

Mark J. Fitzmaurice, White Plains, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Raffaelina Gianfrancesco, Richard Longworth Hecht, and Anthony J. Servino of counsel), for respondent.

Before: Fisher, J.P., Angiolillo, Lott and Sgroi, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
