Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Oneida County Court, rendered May 5, 2011,

Now, upon reading and filing the affirmation of Jeremy D. Alexander, Esq. dated August 19, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the dismissal of the appeal is vacated on the condition that the appeal is perfected on or before December 10, 2013.
