People v. Beaman

Appellate Division of the Supreme Court of New York, First Department
Nov 28, 1989
155 A.D.2d 375 (N.Y. App. Div. 1989)

Opinion

November 28, 1989

Appeal from the Supreme Court, New York County (Joan Carey, J.).

Defendant's claims of prosecutorial misconduct were not preserved for appellate review as a matter of law (CPL 470.05) and we decline to exercise our interest of justice jurisdiction to reach these matters which, upon timely and proper objection, could have been cured. (See, People v Tardbania, 72 N.Y.2d 852.)

Concur — Kupferman, J.P., Milonas, Kassal and Ellerin, JJ.
