On order of the Court, the application for leave to appeal the August 30, 2002 judgment of the Court of Appeals is considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.
Kelly, J., would remand to the Wayne Circuit Court for a further hearing concerning whether the defendant was denied effective assistance of counsel. People v Ginther, 390 Mich. 436 (1973).
