By order of May 18, 2022, the application for leave to appeal the February 16, 2022 order was held in abeyance pending the bypass application in People v Nicolas Lyon, Michigan Supreme Court No. 164191. On June 28, 2022, the Supreme Court reversed the February 16, 2022 order in Lyon and remanded to the circuit court for further proceedings. Because the February 16, 2022 order in Lyon is the same order appealed from in the instant case, Lyon is directly on point and controls the outcome of this case. Accordingly, under MCR 7.205(E)(2), we REVERSE the February 16, 2022 order and REMAND for further proceedings as in Lyon.
We retain no further jurisdiction.
