THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. DAJUAN M. BACOT, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved for a writ of error coram nobis seeking leave to file a late notice of appeal from a judgment of Ontario County Court, rendered April 11, 2014,

Now, upon reading and filing the affidavit of DaJaun Bacot, sworn to December 4, 2015, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied, and

It is further ORDERED that CPL 460.10(6) relief is granted to the extent that the notice of appeal dated April 17, 2014 shall be treated as valid for the judgment of conviction associated with indictment number 13-04-085, and Aaron Sperano, Esq. is directed to serve said notice of appeal in accordance with CPL 460.10 on or before February 19, 2016.
