THE PEOPLE OF THE STATE OF NEW YORK EX REL. ADRIAN ALLEYNE, PETITIONER-APPELLANT, v. AKINYEMI AWOPETU, SUPERINTENDENT OF LIVINGSTON CORRECTIONAL FACILITY, RESPONDENT-RESPONDENT.


PRESENT:

Appellant having moved, pursuant to CPLR 5520 (a), for an extension of time to take an appeal from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Livingston on November 13, 2017,

Now, upon reading and filing the affidavit of Adrian Alleyne sworn to November 26, 2018, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied without prejudice to a motion for the same relief that includes, among other things, a timely motion to vacate dismissal of the appeal and a copy of the notice of entry first served on an opposing party in this matter, along with a copy of any document that was enclosed therewith (see CPLR 5513 [a]).
