People of Michigan v. Marvin Junior Atkins

LC No. 19-005198-01-FH

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.216(A)(7), orders:

The August 16,2022 order dismissing the delayed application for leave to appeal for failure to pursue the case in conformity with the rules is VACATED, and the delayed application is REINSTATED. The matter was dismissed because payment of an entry fee was not timely received. However, this Court has since been notified that, due to an error by an employee of the Michigan Department of Corrections, defendant's payment was not included in an envelope received by this Court on August 3, 2022. The entry fee has since been received. As the delay in receiving the entry fee was due to circumstances beyond defendant's control, the appeal is hereby reinstated, and shall proceed to decision pursuant to MCR 7.205(E).
