ORDER MODIFYING OPINION AND DENYING PETITION FOR HEARING

GOOD CAUSE appearing, the opinion filed in the above entitled matter on September 23, 2008, is modified as follows:

On page 8, in the second line of the first sentence of the second paragraph, the phrase “rape, kidnapping, and” is deleted, so that sentence now reads: “In addition to this, the jury could consider evidence of ESL’s current offenses – the attempted murder of Johana and the attempt to lure Oscar outside to his death.”

On page 8, at line six of the second paragraph, that begins “was the commission,” the words “kidnapping and rape” are deleted and are replaced with “and attempted murder,” so that line six now reads: “was the commission of various crimes, including murder and attempted murder.”

No change in judgment.

Appellant Arreola’s petition for rehearing is denied.
