Judgment of conviction of the County Court of Queens county reversed upon the law and the facts and a new trial ordered upon authority of People v. Santorelli ( ante, p. 705), decided herewith. Lazansky, P.J., Rich, Kapper and Scudder, JJ., concur; Carswell, J., concurs for the reasons stated in his concurring memorandum in People v. Santorelli ( supra).
