People v. Arango

Appellate Division of the Supreme Court of New York, First Department
Jun 3, 1997
240 A.D.2d 170 (N.Y. App. Div. 1997)

Opinion

June 3, 1997

Appeal from the Supreme Court, New York County (Carol Berkman, J., at hearing; Leslie Crocker Snyder, J., at plea and sentence).

Defendant's suppression motion was properly denied. We decline to disturb the hearing court's credibility determinations ( see, People v. Prochilo, 41 N.Y.2d 759, 761). We perceive no abuse of sentencing discretion.

Concur — Sullivan, J.P., Ellerin, Nardelli, Tom and Mazzarelli, JJ.
