Opinion

A149625

12-10-2019

In re A.R., a Person Coming Under the Juvenile Court Law. THE PEOPLE, Plaintiff and Respondent, v. A.R., Defendant and Appellant.

NOT TO BE PUBLISHED IN OFFICIAL REPORTS

California Rules of Court, rule 8.1115(a), prohibits courts and parties from citing or relying on opinions not certified for publication or ordered published, except as specified by rule 8.1115(b). This opinion has not been certified for publication or ordered published for purposes of rule 8.1115. (City & County of San Francisco Super. Ct. No. JW15-6124)

This is an appeal from the imposition of an electronic search condition (ESC) on appellant, A.R., as a term of her juvenile probation. On September 28, 2018, we issued an unpublished opinion rejecting A.R.'s challenges to the ESC and affirming the juvenile court's probation order. (In re A.R. (Sept. 28, 2018, A149625) [nonpub. opn.].) The Supreme Court granted review in docket number S252197 on December 12, 2018, but deferred briefing pending its decision in In re Ricardo P. (2019) 7 Cal.5th 1113, which was later issued on August 15, 2019. On October 16, 2019, the Supreme Court transferred the matter back to this court "with directions to vacate [our] decision and reconsider the cause in light of In re Ricardo P. (2019) 7 Cal.5th 1113."

On October 18, 2019, this court ordered the parties to file supplemental briefs pursuant to the Supreme Court's transfer order, "discussing: (1) whether the validity of the probation conditions is moot, e.g., whether A.R.'s probation term has expired, and whether she is subject to the challenged probation conditions; and if not moot, (2) Ricardo P. and subsequent authority. (See Cal. Rules of Court, rule 8.200(b)(2).)"

On November 1, 2019, A.R.'s counsel sent a letter brief to this court stating that A.R.'s probation ended, and the juvenile court's jurisdiction over her terminated, on March 23, 2018. Counsel states that "[b]ecause [A.R.] is no longer subject to the challenged probation condition, it appears the current appeal is moot." The Attorney General did not file a supplemental brief. We agree the appeal is moot and will dismiss the appeal.

DISPOSITION

The opinion previously filed in this matter, In re A.R. (Sept. 28, 2018, A149625) [nonpub. opn.], is vacated. Because the matter is moot, the appeal is dismissed.

STREETER, Acting P. J. WE CONCUR: TUCHER, J.
