ORDER MODIFYING OPINION AND DENYING REHEARING

P.J.

The opinion in the above-entitled matter filed on November 30, 2007, is modified as follows:

On page 6, delete the third full paragraph and insert the following:

“Another factor cited by the court was that appellant’s prior convictions as an adult and sustained petitions as a juvenile were of increasing seriousness. (Rule 4.421(b)(2).) Appellant concedes this court is required by binding California Supreme Court authority to conclude that factor is supported by the record.”

Appellant’s petition for rehearing is denied.

This modification does not effect a change in the judgment.
