Order granting peremptory mandamus order as against respondent affirmed as matter of law and not of discretion, with fifty dollars costs and disbursements to the relator. (Civil Practice Act, § 1336.) Blackmar, P.J., Rich, Putnam, Kelly and Manning, JJ., concur.
