Appellate Division of the Supreme Court of New York, Second Department
Jan 5, 1996
223 A.D.2d 518 (N.Y. App. Div. 1996)

Opinion

January 5, 1996

Adjudged that the writ is dismissed, without costs or disbursements.

The determination of the Supreme Court, Suffolk County, was not an improvident exercise of discretion, and did not violate "constitutional or statutory standards" (People ex rel. Klein v Kruger, 25 N.Y.2d 497, 499; see, People ex rel. Rosenthal v Wolfson, 48 N.Y.2d 230). Rosenblatt, J.P., O'Brien, Pizzuto and Goldstein, JJ., concur.
