Opinion

February 8, 1971

In a habeas corpus proceeding, relator appeals, as limited by his brief, from so much of a judgment of the County Court, Westchester County, dated January 29, 1970, and entered February 2, 1970, dismissing the writ, as is applicable to him. Appeal dismissed as moot, without costs. It appears from appellant's brief that he has completed service of the sentence which was the predicate of his alleged claim of illegal restraint. Munder, Acting P.J., Martuscello, Shapiro, Christ and Benjamin, JJ., concur.
