Appellate Division of the Supreme Court of New York, Second Department
Dec 5, 1949
276 App. Div. 846 (N.Y. App. Div. 1949)

Opinion

December 5, 1949.

In an action for a separation, order directing payment of $60 per week temporary alimony, and $500 counsel fees, modified by striking from the second ordering paragraph "Sixty ($60.00) Dollars", and substituting in place thereof "Fifty ($50.00) Dollars." As thus modified, the order is affirmed, without costs. Under all the facts and circumstances the amount awarded for temporary alimony was excessive. Nolan, P.J., Carswell, Adel, Sneed and Wenzel, JJ., concur.
