Pennington v. Kelly

Court of Appeals of Texas, Fifth District, Dallas
Jan 7, 2009
No. 05-08-01631-CV (Tex. App. Jan. 7, 2009)

Opinion

No. 05-08-01631-CV

Opinion Filed January 7, 2009.

On Appeal from the County Court at Law No. 2, Dallas County, Texas, Trial Court Cause No. cc-06-08106-B.

Before Chief Justice THOMAS and Justices BRIDGES and FITZGERALD.

MEMORANDUM OPINION

Donald Pennington seeks to appeal the trial court's March 20, 2007 judgment. No motion for new trial was filed; therefore, appellant's notice of appeal was due by April 19, 2007. See Tex. R. App. P. 26.1. Appellant's notice of appeal is file-stamped July 2, 2008, more than one year late. Appellant did not respond to the Court's letter asking for briefs addressing our jurisdiction over the appeal. Because appellant's notice of appeal is untimely, we have no jurisdiction over the appeal. Accordingly, we dismiss the appeal for want of jurisdiction. See Tex. R. App. P. 42.3.
