DECISION & ORDER ON MOTION
Motion by appellant for a stay pending the determination of an appeal from a final judgment of the District Court of Suffolk County, Second District, entered October 1, 2018, and for leave to appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking leave to appeal from the final judgment is denied as unnecessary since appellant has taken an appeal as of right from the final judgment by filing a notice of appeal therefrom; and it is further,
ORDERED that the branch of the motion seeking a stay is denied.
