Paulsen v. State

District Court of Appeal of Florida, Fourth District
Mar 29, 2000
754 So. 2d 812 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D99-0744.

Opinion filed March 29, 2000.

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Victor Tobin, Judge; L.T. Nos. 90-24089CF, 91-4013CF, 91-4015CF, 91-4016CF, 91-4017CF, 91-4018CF, 91-4020CF, 91-4021CF, 91-4022CF, 91-4023CF.

Eric Paulsen, Jasper, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, and David M. Schultz, Assistant Attorney General, West Palm Beach, for appellee.

Erik Paulsen argues that the scoresheet used at the violation of probation hearing was incorrect as it included an extra fifty points. As there is no disagreement that the scoresheet was wrong, we reverse and remand with directions for the trial court to resentence Paulsen within the guidelines based on a corrected scoresheet.

POLEN, FARMER and GROSS, JJ., concur.
