The reporter's record is overdue. The record was originally due November 2, 2023. When the reporter's record had not been filed by December 8, 2022, we directed Kimberly Xavier, Court Reporter for Criminal District Court No. 3, Dallas County, to file the reporter's record by January 9, 2023. On January 9, 2023, Ms. Xavier filed a request for a thirty-day extension of time to file the reporter's record. On January 10, 2023, we granted the request and ordered the reporter's record due February 9, 2023. As of the date of this order, the reporter's record has not been filed, and Ms. Xavier has not communicated further with this Court concerning the reporter's record in this case. We ORDER Kimberly Xavier, Court Reporter for Criminal District Court No. 3, Dallas County to file the reporter's record by MARCH 8, 2023. If the reporter's record is not filed by March 8, 2023, we may order the trial court to hold a hearing and determine why the reporter's record has not been filed.
The Clerk is DIRECTED to send copies of this order to Kimberly Xavier, Court Reporter for Criminal District Court No. 3, Dallas County, and to counsel for all parties.
