ORDER DISMISSING PETITION

This original petition for a writ of mandamus challenges the Nevada Board of Parole Commissioners' denial of parole for Jack Albert Patterson. Patterson alleges the Board failed to follow its own internal guidelines by considering the inapplicable aggravating factor set forth in NAC 213.518(2)(k) when denying his request for parole. Patterson also alleges the Board misused other aggravating factors during his parole hearing. Patterson seeks an order directing the Board to reconsider its decision to deny his request for parole.

On February 5, 2019, Patterson filed a motion to voluntarily dismiss this petition so he can seek relief in the district court in the first instance. We grant the motion, and we
