Patrick v. Richardson

District Court of Appeal of Florida, Fourth District
Nov 9, 1994
644 So. 2d 348 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-2752.

November 9, 1994.

Appeal from the Circuit Court for Palm Beach County; Richard B. Burk, Judge.

George J. Miter, Goldberg, Goldstein Buckley, Fort Meyers, for appellant.

No brief filed by appellee.

The trial court involuntarily dismissed appellant's case:

(1) without prior notice to the parties;

(2) within six months from the last record activity; and

(3) "for lack of interest [ sic]."

We find error in all of the above and consequently reverse.

REVERSED.

POLEN, J., and MAY, MELANIE G., Associate Judge, concur.
