The Court recently became aware of a new conflict requiring the recusal of Judge Patrick J. Urda, to whom this case was submitted. The Court is taking appropriate steps to remedy the conflict and proposes to reassign this case to another judicial officer of this Court for purposes of preparing the opinion and entering the decision based on the record of trial previously held in this case or conducting a new trial.
Therefore, it is
ORDERED that this case is no longer submitted to Judge Patrick J. Urda. It is further
ORDERED that this case is assigned to the undersigned. It is further
ORDERED that, on or before November 22, 2023, the parties shall file with the Court a response to this Order consenting to the reassignment or moving for a new trial or to supplement the record, stating reasons in support of either motion. The Court will then take such action as it deems appropriate.
