On the court’s own motion, and for good cause, it is ordered that the opinion filed herein on July 8, 2010, be modified as follows:

On page 2, in footnote 1, after the last sentence ending “we cannot consider them in this opinion, ” add the following two sentences:

The court observed Parker actively passing notes to Parker Bokelman as she spoke on his behalf. At no time did Parker or Parker Bokelman request a continuance of oral argument or object to submission of the case.

This modification does not effect a change in the judgment.
