STIPULATION TO DISMISS ACTION WITH PREJUDICE


The Parties, Charles Park, in pro per, and FleetBank (RI), National Association, FleetBoston Financial Corporation, Fleet Credit Card Services, L.P. (hereinafter "Defendants"), by and through their counsel, Daniel J. O'Rielly of Severson Werson, having settled this matter, hereby stipulate that this lawsuit be dismissed with prejudice, each party to bear its own attorneys' fees and costs.

The Parties respectfully request that the Court enter the proposed form of Order of Dismissal with Prejudice submitted with this Stipulation.

ORDER OF DISMISSAL WITH PREJUDICE

Pursuant to the Stipulation of the Parties, and good cause appearing, IT IS HEREBY ORDERED, that this Action is dismissed with prejudice, each party to bear its own attorneys' fees and costs.
