This case is calendared for trial at the Court's December 12, 2022, Las Vegas, Nevada trial session. On November 21, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. The motion alleges that respondent has made many unsuccessful attempts to contact petitioner during the past few months, however, petitioner has ceased contact with respondent.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for contradictory hearing at the Court's December 12, 2022, Las Vegas, Nevada trial session. The parties are advised that they should be prepared to commence trial during the Court's December 12, 2022, Las Vegas, Nevada trial session, should the Court deny respondent's Motion to Dismiss for Lack of Prosecution.

Petitioner is advised that her unexcused failure to appear at the Court's December 12, 2022, Las Vegas, Nevada trial session commencing at 10:00a.m. in Room 4-400, 4th Floor, Foley Federal Building & U.S. Courthouse, 300 Las Vegas Blvd., South, Las Vegas, Nevada may result in the granting of respondent's Motion to Dismiss for Lack of Prosecution and entry of decision as requested in respondent's motion.
