ADRIAN THOMAS PACHECO & MARIAH SHANEL PACHECO, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Lewis R. Carluzzo Chief Special Trial Judge

This case for the redetermination of a deficiency is before the Court on respondent's motion for continuance, filed March 13, 2023, and heard on March 28, 2023, when the case was recalled from the calendar for trial in Denver, Colorado. Counsel for respondent appeared and argued in support of the motion. According to the motion, additional time is required to address the I.R.C. section 6015 relief now being requested by one of the petitioners. Mariah Shenel Pacheco appeared on her own behalf and offered no objection to the motion. Adrian Thomas Pacheco appeared, noted his objections, and argued in opposition to the motion. Following a recess taken at the conclusion of the arguments, the parties announced that the parties had reached an agreement with respect to the matters raised in the petition.

Upon due consideration and for cause appearing more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion is granted, in that this case is continued with jurisdiction retained by the undersigned. It is further

ORDERED that unless a stipulated decision is submitted sooner, on or before May 30, 2023, the parties, jointly or separately, report in writing as to the status of the case.
