ORDER


On Monday, December 15, 2008, a telephonic status conference was held with counsel for the parties, the former monitor in this case (Fred Cohen), and the current monitor in this case (Vincent M. Nathan). Mr. Cohen requested that the Court allow him to relinquish his monitor position in this case, and he recommended the Court appoint Mr. Nathan as the new monitor. For the reasons set forth at the status conference by Mr. Cohen, Mr. Nathan, and the parties, and because there are no objections, the Court GRANTS Mr. Cohen's request to resign from his monitor position in this case, and APPOINTS Mr. Nathan as the monitor in this case. This written Order memorializes the Court's Order on the record on December 15, 2008 when the Court granted Mr. Cohen's request to resign and appointed Mr. Nathan as monitor.

IT IS SO ORDERED.
