Dear Judge Kaplan:
I am the attorney for defendant Randy L. Johnson, Jr. I am writing with the consent of all counsel for the represented parties to request a further extension of time to file the pretrial order in this case, currently scheduled for tomorrow, August 10.
The main difficulty for defendant Johnson in preparing the pre-trial order is that we received plaintiffs' 1,509 proposed exhibits on Monday, August 1, and we simply have not had the time to review all of them for objections. I have also been dealing with a family health emergency, as one of my sons has been hospitalized with a serious infection since Sunday August 7. I would anticipate that we would be able to state our objections in time to file the pretrial order by Friday August 19. If the Court does not wish to delay the filing of the entire pretrial order, I would request that the Court permit defendant Johnson separately to file his objections to exhibits by August 19.
