Osbrach v. Osbrach

District Court of Appeal of Florida, Third District
Dec 16, 1982
422 So. 2d 348 (Fla. Dist. Ct. App. 1982)

Opinion

No. 82-762.

November 16, 1982. Rehearing Denied December 16, 1982.

Appeal from Circuit Court, Dade County; Ralph B. Ferguson, Jr., Judge.

Elizabeth S. Baker, Miami, for appellant.

Melvin A. Rubin, Miami, for appellee.

Before HUBBART, C.J., and DANIEL S. PEARSON and JORGENSON, JJ.

There is evidence in the record to support the trial court's finding that the appellant had the ability to pay the child support payments previously ordered and that he willfully failed and refused to do so. Accordingly, the trial court's order of contempt and commitment and order denying the appellant's petition for modification and denying in part relief from judgment are

Affirmed.
