Based upon the Stipulation for Dismissal With Prejudice submitted by Plaintiff Carla Orton and Defendant Smith's Food Drug Centers, Inc. ("Smith's") in this action, and for good cause appearing;

IT IS HEREBY ORDERED that all claims and causes of action of Plaintiff against Smith's are hereby DISMISSED WITH PREJUDICE and on the merits, each party to bear their own costs, expenses and attorneys' fees.
