ORDER DENYING DEFENDANTS' MOTIONS TO DISMISS

The Court, having reviewed the Report and Recommendation of Judge Theresa L. Fricke, United States Magistrate Judge, objections to the Report and Recommendation, if any, and the remaining record, does hereby find and ORDER:

(1) the Court adopts the Report and Recommendation;

(2) Pierce County defendants' motion to dismiss (Dkt. 14) is DENIED;

(3) NaphCare defendants' motion to dismiss (Dkt. 16) is DENIED; and

(4) The case is referred to Magistrate Judge Fricke for further proceedings, and to issue a scheduling order; also, Judge Fricke is requested to inquire about the availability of a pro bono panel attorney; the Court orders that if possible, counsel should be appointed for plaintiff.
