Orange Cty. Sheriff's Office v. Steib

Oct 30, 1997
701 So. 2d 117 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 97-410.

Opinion filed October 30, 1997.

An appeal from an order of Judge of Compensation Claims, Joseph E. Willis, Judge.

Michael L. Peterson, Esquire, and Debrah L. Zeitler, Esquire, of Moore Peterson, P.A., Orlando, for Appellant.

Glen D. Wieland, Esquire, of Kelaher, Wieland Hidalgo, P.A., Orlando and Bill McCabe, Esquire, of Shepherd, McCabe Cooley, Longwood, for Appellee.

The judge of compensation claims did not have jurisdiction to decide appellee's claim for "full pay status" pursuant to section 440.15(12), Florida Statutes (1995). See Williams v. City of Ft. Walton Beach, 691 So.2d 580 (Fla. 1st DCA 1997). Accordingly, we reverse the order on appeal and remand this case to the judge of compensation claims with directions that it be dismissed.

REVERSED and REMANDED.

ERVIN, KAHN, and BENTON, JJ., Concur
