Judgment entered upon a verdict in favor of plaintiff for $12,000, unanimously reversed, on the law and on the facts, on the ground of excessiveness of the verdict and a new trial ordered, with costs to appellant to abide the event, unless the plaintiff stipulates to reduce the verdict to the sum of $8,000, in which event the judgment, as so modified, is affirmed, without costs. Settle order on notice.
