Opinion

No. 04-07-00785-CR

Delivered and Filed: January 9, 2008.

Appeal from the 290th Judicial District Court, Bexar County, Texas Trial Court No. 2007-CR-7017 Honorable Sharon MacRae, Judge Presiding. DISMISSED FOR LACK OF JURISDICTION

Sitting: SANDEE BRYAN MARION, Justice, PHYLIS J. SPEEDLIN, Justice, REBECCA SIMMONS, Justice.

MEMORANDUM OPINION

The clerk's record in appellate cause number 04-07-00785-CR contains an order of the trial court dismissing trial cause number 2007-CR-7017 because "Defendant was convicted in another case or count." Defendant filed a notice of appeal on October 12, 2007. Accordingly, on December 4, 2007, this court ordered defendant to either show cause why appellate cause number 04-07-00785-CR should not be dismissed for want of jurisdiction, or file the appropriate motion to dismiss pursuant to Texas Rule of Appellate Procedure 42.2. Defendant did not respond. We therefore dismiss the appeal for lack of jurisdiction.
