ORDER SETTING FURTHER HEARING ON MOTION FOR PRELIMINARY INJUNCTION


On August 29, 2003, the Court heard argument with respect to Plaintiffs' motion for preliminary injunction. Good cause appearing, the Court hereby sets a further hearing on the motion at 8:30 a.m. on Friday, September 5, 2003. The temporary restraining order enjoining Monterey County from mailing absentee ballots to overseas voters shall remain in place unless and until preclearance is obtained as to all asserted changes raised by Plaintiffs' complaint or until further order of the Court.

Each party shall advise the Court as to any change in the status of the Section 5 preclearance requests pending before the Department of Justice.

IT IS SO ORDERED.
