Oldham v. State

Supreme Court of Delaware
Oct 13, 2004
No. 346, 2004 (Del. Oct. 13, 2004)

Opinion

No. 346, 2004.

Submitted: August 26, 2004.

Decided: October 13, 2004.

Superior Court of the State of Delaware, in and for New Castle County, Cr.A. Nos. IN92-02-1052 thru -1054, and -1056, Cr. ID 92001855DI.

Before STEELE, Chief Justice, HOLLAND, and BERGER, Justices.

ORDER

This 13th day of October 2004, after careful consideration of the appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Superior Court's well-reasoned decision dated July 28, 2004. The Superior Court did not err in concluding that Oldham's motion for postconviction relief was time-barred and that Oldham had failed to overcome this procedural hurdle.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
