(CLAIM NO. 123652.) PRESENT:

Appellant having moved for permission to proceed as a poor person and for permission to appeal an order of the Court of Claims entered in the Office of the Clerk of said court on February 21, 2018,

Now, upon reading and filing the affidavits of Emeka Dominic Okongwu sworn to September 10, 2018, and October 22, 2018, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied on the ground that no appeal lies from an order denying a motion to reargue (see CPLR 5701 [a] [2] [viii]; MidFirst Bank v Storto, 121 AD3d, 1575 [4th Dept 2014]).
