Present — Lazansky, P.J., Hagarty, Davis, Johnston and Taylor, JJ.


In an action to recover on a life insurance policy it appeared that the policy lapsed by reason of non-payment of premium within the grace period. Questions of the notice given by defendant under the provisions of section 92 Ins. of the Insurance Law and of waiver by defendant were submitted to the jury, which found a verdict for defendant. Judgment unanimously affirmed, with costs. No opinion.
