Appellants Nueces Hospitality GP, LLC and Nueces Hospitality, LP have filed a motion to dismiss this appeal as improvidently filed. See TEX. R. APP. P. 42.1(a)(1). The Court, having considered the documents on file and the motion to dismiss the appeal, is of the opinion that the motion should be granted. See TEX. R. APP. P. 42.1(a). The motion to dismiss is granted and the appeal is hereby DISMISSED. Appellants shall bear the costs of this appeal. See id. R. 42.1(d). The original proceeding filed in appellate cause number 13-17-00453-CV remains pending in this Court.
